Attorney's legal argument precedes Louisiana publicity rights law

The Advocate reported on the Louisiana Supreme Court's affirmation dismissing the Barry Seal estate lawsuit over film rights. Attorney Roy Maughan Jr., representing the estate, argued Louisiana should recognize post-mortem publicity rights. While unsuccessful in 2019, Maughan's legal argument proved prescient—in 2022, Louisiana enacted the Allen Toussaint Legacy Act, creating exactly the heritable identity rights framework he had advocated.
